APPELLATE DIVISION DENIES VILLAGES'
REQUEST TO FILE AN AMICUS CURIAE BRIEF IN THE MATTER OF BERNSTEIN v. FEINER
The following comment by
Edgemont attorney Bob Bernstein explains the legal briefs available below:
"In another victory
for the people of unincorporated Greenburgh, the Appellate Division, Second
Department, has issued an order denying the so-called Village Officials
Committee permission to file an amicus curiae brief in support of the Town's
position on the Taxter appeal. The ruling means that the villages'
brief, which was already written, will not be filed and won't be read or
considered on the appeal. The VOC will also not be heard at any oral
argument. The ruling was based on the papers I filed in opposition to the
VOC's submission. Enclosed is a copy of the court's order. Also enclosed is
a copy of the Town's "reply" brief in further support of its position on the
appeal and in answer to the arguments that I raised in opposition to the
Town's original brief. The matter is now fully briefed and awaiting oral
argument."
