GRASSROOTS FOR GREENBURGH THE TOWN LOSES AGAIN--BERNSTEIN PREVAILS ON TAXTER RIDGE The following document contains the ruling issued by the Supreme Court of the State of New York, County of Westchester, in the case of Bernstein vs. Feiner and the Town of Greenburgh. On May 6, 2005, the Court denied the Town's motion for reargument of the February 17, 2005 ruling in which the Court held in Bernstein's favor. Bernstein challenged the Town of Greenburgh for acting improperly in assessing the costs of acquiring, operating and maintaining Taxter Ridge Park on only unincorporated Greenburgh and not the entire Town, which includes the six villages. This ruling established the principle that parks and recreational facilities open town-wide must be paid for town-wide.
