GRASSROOTS FOR GREENBURGH September 21, 2006 FEINER APPOINTEE REPRESENTING VILLAGES IN BERNSTEIN II LITIGATION Herbert Rosenberg, the controversial Dobbs Ferry lawyer who chaired Paul Feiner's committee to study budget disputes between Greenburgh's villages and its unincorporated areas, has apparently been secretly representing the villages in their thus far unsuccessful attempt to intervene in Bernstein II. Rosenberg's representation of the villages was not disclosed in any court papers filed by the villages. However, he is identified as their counsel in the retention agreement entered into by and between the villages and the White Plains law firm of Keane & Beane. The agreement states in pertinent part that "Herbert Rosenberg, Esq. has agreed to assist on a pro bono basis, and lend his expertise and knowledge in drafting documents." Rosenberg's committee drafted a report which appears on the Town's website. Bernstein had criticized the report for containing materially misleading information as to the facts and the law. The Keane & Beane retention agreement required the villages to pay an upfront retainer fee in the amount of $30,000, plus costs. Bernstein is handling this matter at his own expense. Provided below is a copy of the retention agreement so that GfG readers can see for themselves that Feiner and Rosenberg are working in concert with the villages. --Bob Bernstein
